Rishi Raj Singh wasn't joking or being over zealous


Mr.Rishi Raj  Singh was addressing a group of people at an event in Kochi about women’s safety when he made the statement which provoked such social media reactions/internet trolls & jokes. But this is serious stuff actually!.
Right now this “crime” of looking/staring at women(in public places, office, transport systems, etc.,.) is already covered in the amended criminal laws related sexual violence against women, vide recommendations by Justice Verma committee(http://www.thehindu.com/news/resources/full-text-of-justice-vermas-report-pdf/article4339457.ece) .
 
This is also kind of a the precursor of the proposed "Protection of privacy and dignity of women bill- 2013, Kerala - in short PDWA".

Excerpt: The state government will put forth a bill demanding death penalty for culprits causing the death of a woman through rape, harassment or other such offences listed in the Indian Penal Code. The draft Kerala Protection of Privacy and Dignity of Women Bill, 2013, will be brought out soon. Even though the state government had taken steps to bring in the law against atrocities on women much earlier, the need for such a law got strengthened in the wake of Delhi gang rape case. Section 5 of the proposed bill states that if a women commits suicide and if its established that soon before her death she was subjected to harassment or that any offences have been committed against her under sections 294 (obscene act in public places); 354 (intention to outrage the modesty of a woman); 375 (rape); or 509 ( gestures, words and so on intended to hurt the dignity of a woman) of the Indian Penal Code, such death shall be deemed to be death caused by harassment unless it is proved otherwise. Section 3 prohibits harassment of women in any place, including cyberspace. The punishment for harassment will be imprisonment for a term which shall not be less than seven years, but may extend to imprisonment for life and with fine. Section 4(b) says punishment for harassment leading to death includes life imprisonment with fine, besides the death penalty, while Section 14 ensures privacy during trial by making it mandatory to hold it in-camera.

Excerpt: Supreme Court lawyer K V Dhananjaya who spoke to India Today about the incident called it a “mindless” statement to make. “There is no such provision in any law of this country and there cannot be such a mindless provision of law in any other country of the world. Period.” ............... Now we know how stupid even Supreme lawyers can be!.... there are already various sections of IPC which covers this "crime"(IPC sections 354 and 509 as explained above) .....it's a set of central criminal laws that the SC lawyer is unaware of!!!...
 
.....well most us are unaware of this!!!, we better get vigilant and act to protect our rights, our male relatives(including own sons) and friends' rights, else we may find ourselves/our dear ones in such framed and false cases soon!!!.

PPS: It's actually left to the "feeling" or "discretion" of the "victim" of the alleged "#stare rape", so it need not be even 14 seconds!!!.. 

The text of all these laws and government orders clearly mention this, in addition to this the victim isn't required to submit any evidence with such allegations, the proceedings will happen secretly, media is not allowed report the victim's name, so with nothing to loose this is going to be the next best weapon fit for misuse for wrecking vengeance and for demanding ransoms, etc.,......  So ... enjoy guys...  It's show time

Sexual violence against women: related IPC sections



509. Word, gesture or act(even a 1 second look or the absence of a desired look!) intended to insult the modesty of a woman.—Whoever, intending to insult the modesty of any woman, utters any word, makes any sound or gesture, or exhibits any object, intending that such word or sound shall be heard, or that such gesture or object shall be seen, by such woman, or intrudes upon the privacy of such woman, shall be punished with simple imprisonment for a term which may extend to one year, or with fine, or with both.


354. Assault or criminal force to woman with intent to outrage her modesty.—Whoever assaults or uses criminal force to any woman, intending to outrage or knowing it to be likely that he will thereby outrage her modesty, shall be punished with impris­onment of either description for a term which may extend to two years, or with fine, or with both.
267 [294. Obscene acts and songs.—Whoever, to the annoyance of others—
(a) does any obscene act in any public place, or
(b) sings, recites or utters any obscene song, ballad or words, in or near any public place, shall be punished with imprisonment of either description for a term which may extend to three months, or with fine, or with both.]
